Mae llawer o bobl jyst yn derbyn y gosb, gan eu bod yn teimlo nad oes unrhyw beth y gallant ei wneud i'w osgoi, fodd bynnag, mae llawer o sancsiynau yn anghyfreithlon mewn gwirionedd o dan Ddeddf Ceiswyr Gwaith 1995 sy'n cynnwys prawf eithaf syml. Wrth gwrs, mae'n wych os oes llawer o swyddi y gallwch wneud cais amdano'n wirioneddol pob wythnos, ond yr ydym i gyd yn gwybod bod weithiau does dim byd i wneud cais amdano. Weithiau, nid oes hyd yn oed tri cham mewn wythnos i cymryd, ac felly weithiau gallai fod yn berffaith resymol i gymryd llai na tri cham, neu hyd yn oed dim, yn dibynnu ar yr amgylchiadau. Ar hyn o bryd dim ond tua un o bob tri o bobl sydd yn apelio yn erbyn cosb o'u budd-daliadau, ond o'r rhai sydd yn apelio, dros 50% yn enill eu hachos, h.y. ennill eu hapêl. Dylech hefyd wneud cais cyn gynted ag y gallwch i gael Lwfans Caledi, ac ewch i weld y swyddfa Budd-dal Tai a Budd-dal y Dreth Gyngor y cyngor, gan y bydd y DWP wedi rhoi gwybod iddynt, a bydd eich Budd-dal Tai a Budd-dal y Dreth Gyngor wedi cael ei stopio. Bydd angen i chi wneud hyn a elwir yn hawliad sero incwm. Mae'n rhaid i chi wneud hyn, os ydych chi wedi newydd gael ei sancsiynu, y peth olaf ei angen arnoch yw mynd i ddyled gyda'ch rhent ac yn wynebu cael eich taflu allan o'ch cartref. Fel cam cyntaf, rhaid i chi fynd drwy'r hyn a elwir yn Ailystyried Gorfodol, ac mae'n beth hawdd i'w wneud. Er y gallwch ofyn am un dros y ffôn, cyngor cyfredol yw gofyn amdano yn ysgrifenedig, fel yna mae gennych gofnod. Fel y gwyddom, celwyddgwn cynehnid ydyn nhw! Gall y Ganolfan Byd Gwaith eich ffonio i gael rhagor o wybodaeth, ond mae'n ddoeth i beidio ond dweud y byddwch yn cyflwyno wybodaeth ysgrifenedig pellach, a bod o hynny ymlaen a fydd chyfathrebu yn ysgrifenedig yn unig. Unwaith eto, mae'n golygu bod gennych dystiolaeth. IF YOU GET A JSA SANCTION
As we know, the DWP likes to sanction unemployed workers if they decide that you haven't been Actively Seeking Employment, (ASE). Many people just accept the sanction, as they feel that there is nothing they can do to avoid it, however, many sanctions are actually unlawful under the Jobseekers Act 1995 which contains a pretty simple test. In order to to be eligible to claim Jobseekers Allowance, you must be Actively Seeking Employment, and the test applied is that you are 'taking two or more steps each week' (say 3) towards finding employment. So, even if your Jobseeker's Agreement/ Claimant Committment (JSAg/CC) indicates a huge amount that your Jobcentre Plus advisor says you must do or get sanctioned, they are not telling the truth, (even if they believe they are). It doesn't matter what is in your JSAg/CC – the test in the 1995 Act still applies. Of course, it's great if there are lots of jobs that you can genuinely apply for each week, but we all know that sometimes there just aren't. Sometimes there aren't even three steps in a week we can take, and so sometimes it might be perfectly reasonable to take fewer than three steps, or even none, depending on the circumstances. It's also important to understand that the test in the 1995 Act is a weekly test, not a daily one, so you don't have to be searching every day, in spite of what your Jobcentre Plus advisor might say, (and themselves believe - many of them are amazingly ignorant about the rules, and get all their information from their line managers, who seem to be a bunch of congenital liars). You should always appeal a sanction of your JSA. Currently only about one in three people appeal a sanction of their benefits, but of those who do appeal, over 50% are successful in getting the sanction overturned, i.e. winning their appeal. You should also apply as soon as you can for a Hardship Allowance, and go and see the council's Housing Benefit and Council Tax Benefit office, as the DWP will have informed them, and your Housing Benefit and Council Tax Benefit will have been stopped. You'll need to make what is called a zero income claim. You must do this, if you've just been sanctioned, the last thing you need is to get into arrears with your rent and face possible eviction from your home. As a first step, you have to go through what is known as a Mandatory Reconsideration, and it's easy thing to do. Whilst you can request one over the phone, current advice is to request it in writing, as then you have a record. Jobcentre Plus may phone you to get further information, but it's wise to just say that you will submit further infornation in writing, and that from then on all communication will be in writing. Again, it means you have evidence. You can get the support of your local Citizen's Advice Bureau, or local Law Centre, council Welfare Rights Team or even your local MP (the DWP seem to be very scared of MPs getting involved), though not all MPs are created equal, so yours might just be a reactionary fool. If all that fails, you should take it to Independent Tribunal stage, which will cost you nothing, and indeed, if you have to travel any distance, you can claim expenses. You don't have to attend the hearing, but it's in your own best interests to attend, as, even if you have no proof, you are likely to be believed by the judge. Often the DWP doesn't even send someone to represent their side of things, so in that scenario you have a huge edge on them because you did turn up. It's also often the case that the DWP's paperwork is so badly presented that their case fails, and you win.
